The article examines the federal court case of Earthjustice versus the Cove Point LNG project, in which environmental groups are claiming that FERC has the responsibility to consider a facility's life-cycle impacts under the National Environmental Policy Act. "I would think it would be more likely than not that the court will uphold the FERC decisions," said Fagan. "And then the arguments about the impacts of the gas production...I think it's pretty clear the court will find that's speculative."
