Massachusetts Lawyers Weekly Publishes Analysis by Leiha Macauley of Supreme Court Decision

Leiha Macauley co-authored an article for Massachusetts Lawyers Weekly that discussed the Supreme Court's recent decision in United States v. Jicarilla Apache Nation, which involved a discovery dispute arising from a breach-of-trust action. In the case, the justices endorsed a so-called "fiduciary exception" to the attorney-client privilege, which says that a trustee who obtains legal advice related to trust administration is precluded from asserting attorney-client privilege against trust beneficiaries with respect to that advice.
