Walk Before You Run: Why Technical Competence Must Precede AI Literacy

On December 4, 2025, Day Pitney Counsel Ashley Picker Dubin participated in Exterro’s e-Discovery Day program, “Walk Before You Run: Why Technical Competence Must Precede AI Literacy.”

The session examined why technical competence remains essential as firms increasingly adopt AI in litigation and discovery. Speakers discussed the ongoing challenges many lawyers face with core skills in discovery platforms, data security, and collaboration tools, despite the ABA’s longstanding duty of technology competence. The panel, hosted by members of the ACEDS Code & Counsel Working Group, outlined the risks of integrating AI without this foundation and offered practical steps to ensure the defensible, transparent, and responsible use of emerging technologies. The program emphasized that while AI offers significant efficiencies, defensibility depends on strong technical discipline and oversight.
