"Trustee Disbursement Decisions After the SSI In-kind Support Overhaul," myLawCLE
On October 29, Day Pitney attorney Meredith H. Greene co-presented “Trustee Disbursement Decisions After the SSI In-kind Support Overhaul” with Michelle M. Mulvena of Mulvena Winston, PC, as part of myLawCLE’s Special Needs Trust Disbursements After the SSI Overhaul program.
The session examined SSI policy changes that took effect in 2024, changes to ABLE accounts that took effect in 2026 and their implications for special needs trust payments for food and shelter. Topics included the revised in-kind support and maintenance rules, the nationwide presumed maximum value (PMV) standard for rental subsidies, housing expenses that may still reduce SSI payments, updates to ABLE accounts and strategies for structuring disbursements to preserve SSI and Medicaid benefits.
