Quince Antitrust Row Over Ugg IP Suits Must Navigate Free Speech
New York IP Counsel Claire Gibson was recently featured in Bloomberg Law examining Quince’s antitrust lawsuit against Deckers Outdoor Corp., which alleges the Ugg brand owner engaged in a high-volume, “rinse-and-repeat” trade dress enforcement strategy to stifle competition. In the piece, she discusses why it is prudent for companies to position themselves for rights enforcement by securing a portfolio of registrations, the implications of prior rulings finding certain Ugg trade dress to be non-distinctive, and how the case could influence intellectual property enforcement strategies across the industry.
Addressing the possible impact should Quince prevail, Gibson noted, nobody should expect trade dress litigation to fall off a cliff: “Companies have the right to enforce their intellectual property rights.”
