Overview

Joseph "Joe" Ritter handles complex commercial litigation matters. He advises businesses in complex commercial disputes and litigation in the state and federal courts in New Jersey. Joe conducts discovery and drafts motions and briefs. He also assists clients in internal investigations and enforcement actions.

Joe is actively involved in pro bono matters. He regularly acts as a court-appointed representative of allegedly incapacitated persons in guardianship proceedings in New Jersey.

Joe was a summer associate with Day Pitney in 2019. Prior to joining Day Pitney, he served as a legal intern in the New Jersey Office of the Attorney General, Consumer Fraud Prosecution Section, where he assisted in investigations and litigation pertaining to the New Jersey Consumer Fraud Act.

Experience

Represented Financial Services Firm in week-long arbitration with allegations of violations of certain FINRA rules; all claims were dismissed against Firm

Represented a national retailer before the New Jersey Superior Court, Appellate Division; on appeal, successfully argued the improper use of an outdated jury charge that inappropriately raised the standard of liability, and the Appellate Division reversed the liability determination and granted a new trial on that subject

Represented large energy utilities in multiple class action lawsuits in federal courts alleging improper collection of tax gross-up. Successfully argued that the federal courts lacked subject matter jurisdiction to consider the sought-after relief on particular questions of federal tax and that no supplemental jurisdiction existed over remaining state law claims. All claims were dismissed against energy utilities in all jurisdictions that the cases were brought, and all appeals were denied
