Kevin Castel for the Southern District of New York has signed off on an order allowing CBF and other Brazilian plaintiff companies to secure $48.4 million through money, property or interest in property belonging to coal billionaire Hans J. Mende and a company he controlled, AMCI Holdings Inc., who allegedly orchestrated fraudulent transfers to avoid paying plaintiffs an arbitration award issued by the International Chamber of Commerce in 2011. Judge Castel's July 16, 2019 ruling confirmed the ex parte order of prejudgment attachment he issued in June of this year.
