Day Pitney is representing seven New Jersey hospitals in a lawsuit against Horizon Healthcare, relating to its new, two-tiered health plan called OMNIA. The litigation in three New Jersey courts has been to compel Horizon to reveal documents that would reveal how it made decisions on which hospitals should be tier 1 and which hospitals should be tier 2. The trial judge has ordered Horizon to produce documents and information that have begun to explain the process Horizon followed and its decision-making. The approval of OMNIA by the Department of Banking and Insurance is also being challenged by the Hospitals who are represented by separate counsel.
