New OIG Compliance Program Guidance for MA Warns of Prior Authorization Risks
Day Pitney Partner and co-chair of the firm’s Data Privacy, Protection and Litigation practice, William Roberts, was featured in Report on Medicare Compliance discussing recent Office of Inspector General (OIG) audit activity and what it signals for hospitals’ compliance with Medicare Conditions of Participation. Roberts highlighted how the OIG is using audits to raise expectations around operational cybersecurity practices, including vendor oversight, authentication controls, and compliance that extends beyond written policies.
Commenting on the OIG’s enforcement posture and its interpretation of existing requirements, Roberts noted: “It’s a muscular approach to interpreting the CoPs…this is now what we think these words mean in the CoPs. It is in effect creating a higher bar to pass them.”
