Overview

Jaclyn Diffley advises clients on domestic and international trademark, copyright, domain name and brand protection matters. She works with clients throughout the trademark lifecycle, including clearance, prosecution, portfolio management, enforcement and dispute resolution. Her experience spans a variety of industries, including publishing, fashion, retail, gaming and emerging technologies.

Jaclyn manages international trademark portfolios and develops filing and enforcement strategies tailored to clients’ business objectives. She has prosecuted trademark applications before the U.S. Patent and Trademark Office (USPTO), UK Intellectual Property Office (UKIPO) and European Union Intellectual Property Office (EUIPO), including preparing responses to office actions and absolute grounds refusals. She also has experience with opposition and cancellation proceedings before the Trademark Trial and Appeal Board (TTAB), UKIPO and EUIPO.

In addition, Jaclyn advises clients on global trademark watch programs, online brand protection and domain name enforcement. She prepares cease and desist letters and negotiates and drafts settlement, coexistence, licensing and assignment agreements. Her litigation experience includes drafting pleadings, dispositive motions, discovery requests and legal memoranda in trademark and copyright matters.

Prior to joining Day Pitney, Jaclyn practiced at an intellectual property firm in London, where she advised clients on U.S., UK and EU trademark matters and served as the primary contact for several international portfolios. She previously practiced at a New York law firm, focusing on trademark and copyright prosecution, enforcement and litigation.
