Paul Williams and Kaitlin Canty Co-author Article on Product Liability Concerns For Trademark Licensors

Day Pitney attorneys Paul Williams and Kaitlin Canty co-authored an article in the December 5 issue of The Connecticut Law Tribune in which they discuss that while courts have been grappling with whether to hold trademark licensors liable for defective products, even where they neither manufactured nor sold defective products, it appears a consensus regarding this liability issue is on the horizon. The article notes that "the interplay between the Lanham Act, which permits licensors to retain their trademarks if they do not completely abandon them, and courts' imposition of liability on trademark licensors who appear to exercise too much control."
