She noted that while Florida may recognize out-of-state wills, strict execution requirements and unique laws governing homestead property and spousal rights can render such documents invalid or lead to unintended results. Rodriguez urged retirees to review and update their wills, trusts, and advance directives to ensure compliance with Florida law and avoid costly probate disputes.
As she explained, “Without adjustment, an out-of-state will could lead to results the individual did not intend, such as limiting the ability to control who inherits the family home or triggering spousal entitlements inconsistent with the overall plan.”
