Since the amendments to the Americans with Disabilities Act, employers must focus more on whether they are able to accommodate employees' disability-related needs rather than on whether such employees are "disabled." Following the proper steps and effectively documenting is critical in meeting employers' obligation to provide reasonable accommodation and/or in defending against litigation.
