Overview

Phoebe Roth provides comprehensive legal representation to clients in the healthcare industry on state and federal regulatory compliance, transactional matters, and general business and corporate issues.  Her clients include hospitals, surgery centers, physician groups, medical spas, and other health care providers and businesses.

Phoebe is experienced in healthcare transactions and represents clients throughout all aspects of the dealmaking process, from drafting and negotiating definitive documents, to reviewing and analyzing due diligence, to advising on other legal issues in connection with purchases and sales of health care entities.  Additionally, Phoebe supports clients in structuring new medical and other healthcare and wellness practices, the formation of new legal entities and drafting of the accompanying documentation and obtaining appropriate licensure.

Phoebe advises clients on federal healthcare regulatory issues including the Stark Law, the Anti-Kickback Statute, and the False Claims Act.  She is also experienced in state regulatory issues including licensure of healthcare entities and individual providers, the Certificate of Need Process, and state privacy laws.  Phoebe has represented health care providers in fraud and abuse investigations as well as Medicare and Medicaid audits.

Phoebe is a frequent contributor to C.H.A.T., Day Pitney's newsletter on cybersecurity, healthcare and technology, along with other national publications.  She supports the firm's commitment to pro-bono work by serving as a volunteer attorney with child advocacy organization Lawyers for Children America, where she provides legal representation to children in Connecticut who have been abused, neglected, or abandoned. Prior to joining Day Pitney, Phoebe litigated commercial health care matters and represented whistleblowers in state and federal qui tam actions.  Additionally, Phoebe served as a judicial clerk at the Rhode Island Supreme Court, where she concentrated on civil law with an emphasis on business and health care matters.
