Overview

Tom O'Neill, a litigator and trial attorney, represents individuals and businesses in bankruptcy proceedings, tort litigation, commercial litigation and collection matters, including foreclosure actions and prejudgment remedy proceedings. Tom also represents clients in complex litigation, including claims for fraud, commercial lease disputes, corporate dissolutions, claims for breaches of fiduciary duties, and violations of the Connecticut Unfair Trade Practices Act (CUTPA).

Represents secured and unsecured creditors who seek to recover debts and to protect their rights against bankrupt debtors, including obtaining relief from the automatic stay to pursue debt secured by collateral

Represents creditors in hearings to confirm proposed plans of reorganization filed by debtors

Represents vendors and suppliers of consumer products in preference actions and adversary proceedings commenced by bankrupt debtors and trustees who are seeking to recover money paid to the vendors prior to the bankruptcy filing

Counsels clients on various bankruptcy issues, including contract rights and commercial landlord tenant relationships

Represents clients in workouts of financing agreements

Represents financial institutions seeking to satisfy loan obligations through foreclosure proceedings and the appointment of receivers

Represents judgment creditors in post-judgment collection proceedings, including enforcement of judgment liens

Represents clients involved in real estate disputes, including the dissolution of mechanic's liens and the enforcement of landlord-tenant rights and remedies

Represents plaintiffs seeking to obtain judgments by first securing payment pursuant to the prejudgment remedy statutes

Represents clients involved in complex commercial litigation disputes, including claims for breach of contract, breaches of fiduciary duties, and alleged violations of the Connecticut Unfair Trade Practices Act

Represents clients in the defense of negligence claims, premises liability claims, and claims seeking a recovery for significant injuries and death
