Judge finds probable cause in complaint against Christie over GWB lane closures

Dennis Kearney was quoted in an article, "Judge finds probable cause in complaint against Christie over GWB lane closures," in The Record. In the article, Kearney discusses a New Jersey judge's finding of probable cause that Christie engaged in official misconduct during the 2013 lane closures and issued a summons for the governor to appear Oct. 24. Kearney said that the judge made his finding of probable cause on "double hearsay." "It's an out-of-court statement in front of this judge about an out-of-court statement that was made in front of another judge," Kearney said. "Let’s assume the worst-case scenario for the governor, and that is, on appeal, the court says a reasonable fact finder may find probable cause on this. I would be shocked if the Bergen County prosecutor or the Attorney General's Office, were to take over the case or would do anything while the federal trial is pending."
