The article is about how a recent string of victories for class action plaintiffs accusing businesses of violation of a New Jersey consumer protection law has left companies facing an explosion of similar suits. Many defense attorneys feel that the statute is ambiguous and exposes businesses to unfair readings of e-commerce terms and other contract language. "What constitutes a 'clearly established legal right' really is subject to a lot of different interpretations," said Halasz, noting the law effectively requires an analysis of every aspect of a company's terms, conditions and disclosures.
