Harold Blinderman was mentioned in an article, “D.C. Circuit MATS Decision Could Disrupt EPA Plans,” in Bloomberg BNA. The article previews upcoming argument before the D.C Circuit Court of Appeals relative to the U.S. Environmental Protection Agency's rule regulating mercury and other air toxics from power plants. At issue is whether the rule, prior to further proceedings by EPA., should be vacated or kept in place. Blinderman says in the article that how the Court of Appeals proceeds depends on how much deference the Court allows EPA and that, if the Court decides to vacate the rule, they could require EPA to start all over again and propose a new rule.
