The article reviews key energy-related issues the U.S. Supreme Court justices are set to consider in the upcoming term. Doot explained the issues presented in petitions to the Supreme Court to review rulings by the Third and Fourth circuits that upheld District Court rulings that state programs in Maryland and New Jersey that offered electricity pricing incentives for developers to build new, gas-fired power plants usurp FERC's authority over wholesale electric markets run by PJM Interconnection LLC, a mid-Atlantic grid operator.
