Day Pitney's Trial Victory for Elizabethtown Water Co. Featured in Law360
A Day Pitney litigation team, led by former partner and now of counsel?Bob Rose, won a hard fought 14-year court battle on behalf of clients Elizabethtown Water Co., now New Jersey American Water Company, and Vollers Excavating & Construction Company. On February 12, New Jersey State Judge Donald S. Coburn granted Elizabethtown Water's motions for involuntary dismissal of the long-running $12 million contract dispute between the NJ water company and developer Watchung Square Associates LLC. The dispute arose in 2001 after a slope on the side of a mountain being excavated failed and delayed construction of the Watchung Square Mall. But after Watchung presented its evidence of liability for the slope failure, Law360 reported that Judge Coburn granted Elizabethtown Water's motions for involuntary dismissal.
