NJLJ Notes John O'Reilly's Success in Quashing Subpoena of Defense Attorney
Day Pitney litigation partner John O'Reilly successfully moved to quash a subpoena which may have resulted in a defense attorney having to reveal the contents of private text messages sent by his client after fleeing the courthouse. The Hudson County ruling was covered in a May 6 New Jersey Law Journal article, "Texts Between Absconding Client And Lawyer Safe From Subpoena." John, who is a trustee of the Association of Criminal Defense Lawyers of New Jersey, told the journal that the ruling "strikes a blow for public defenders' integrity and independence."
