Law360 Covers Decision in Favor of Day Pitney Client in NJ Trade Secrets Case
Law360 reported the recent favorable decision for Day Pitney's client SCS Healthcare Marketing LLC in an article that appeared December 12. This was a case of first impression where the Chancery Court considered if common law claims were preempted by the recently adopted New Jersey Trade Secret Act. The judge ruled that allegations against Allergan USA Inc. would not be thrown out in light of the act. In the article, Tony Marchetta says, "This means an individual can assert claims of misappropriation of trade secrets as well as common law claims that protect different levels of information." The case is being handled by Tony Marchetta, Maureen Pavely, Jennifer Gorga Capone and Kathy Trawinski.
