Joy Sperling and Michael Weiss co-authored an article on the validity of mortgages registered through Mortgage Electronic Registration Systems, Inc. that appeared in the July 2011 issue of Bloomberg's Banking & Finance Law Report. The article analyzed federal and state court decisions in New York that could have a significant impact on lenders in that state and across the country. It discussed two court decisions in particular, indicating that foreclosure actions could not proceed on mortgages assigned through the MERS system. In the absence of any guidance from state legislatures, Joy and Mike noted that "MERS and its members will face more challenges to their foreclosure practices."
