Daniel Carragher's article on Section 363 of the U.S. Bankruptcy Code, "Sales to Insiders: Are They Entirely Fair?", was published in the November issue of the American Bankruptcy Institute Journal. The article looks at whether insider sales in bankruptcy proceedings are conducted in a fair manner. Dan concludes that courts must conduct thorough examinations of the sale process to determine whether the debtor has "truly pursued sales to third-party buyers and created a level playing field for outsiders."
