Mortgage Lender Loses Appeal in MA Foreclosure Case

Thomas J. O'Neill and Melissa Bruynell Manesse authored an article, "Mortgage Lender Loses Appeal in MA Foreclosure Case," for Mortgage Daily. The article discusses the recent Massachusetts Supreme Judicial Court decision, Federal National Mortgage Association v. Elvitria M. Marroquin, et al., SJC-12139, which will affect Massachusetts foreclosure and eviction practice significantly by clarifying existing law about foreclosure pursuant to the statutory power of sale. In Marroquin, the authors write, the Court held that its ruling in Pinti v. Emigrant Mortgage Co., 472 Mass. 226, 227, 232 (2015) "applies in any case where the issue was timely and fairly asserted in the trial court or on appeal before July 17, 2015."
