FDCPA Liability: Do Lawyers Need Protection Too?

Joy Sperling and Lisa Gonzalo wrote an article that appeared in Law360 on debt collectors' liability for indirect communications with consumers under the Fair Debt Collection Practices Act (FDCPA). Several appellate courts have recently looked at whether a communication with a consumer's lawyer is still subject to FDCPA liability. Joy and Lisa recommend that, until a final ruling is made by the Supreme Court, the safest course of action "is to assume that all communications concerning an attempt to collect a debt?... will be evaluated under the strictures of the FDCPA."
