"Enforcing a Debt When the Lender Is Not in Possession of the Note" looks at Bank of America v. Alvarado, in which the court ruled that a lender does not have to demonstrate physical possession of the note memorializing the underlying debt if it seeks to foreclose on a mortgage. Joy and Peter point out that the Alvarado decision is an important milestone for New Jersey courts in recognizing the rights of lenders that do not possess an original note.
