FMLA Leave Is Exhausted: How to Address Transfer and ADA Accommodation Requests, Fitness-for-Duty Exams, and More

January 7, 2020

On January 7, Francine Esposito presented a live webinar, "FMLA Leave Is Exhausted: How to Address Transfer and ADA Accommodation Requests, Fitness-for-Duty Exams, and More," sponsored by BLR.

During this webinar, Francine discussed several complex issues, including:

  • How employers can determine whether they complied with the requirements under the federal Family and Medical Leave Act (FMLA) and whether employees have actually exhausted their FMLA leave entitlement;
  • The importance of assessing employees' requests for leave in addition to that required by the FMLA, based upon the individual circumstances and the applicable law of the jurisdiction in question (which can vary greatly)
  • The practical factors employers must assess in determining whether they are obligated to grant leave time as a reasonable accommodation under disability discrimination law (ADA and state laws);
  • The interplay of various federal, state and local laws and benefit entitlements; and
  • The roles of Human Resources and supervisors in recognizing and effectively handling leave issues.
