Labor Related Requirements in Redevelopment Related Agreements

Patrick McCarthy and Christopher Stracco spoke about Project Labor Agreements on Friday, February 10, at the New Jersey Institute of Continuing Legal Education's Annual 2017 Redevelopment Law Institute at the Renaissance Woodbridge Hotel in Iselin, New Jersey. McCarthy and Stracco spoke on a panel discussing "Labor Related Requirements in Redevelopment Related Agreements," and particular attention was given to the significance of the Third Circuit Court's of Appeals' recent decision in Associated Builders & Contractors, Inc. v. City of Jersey City, 836 F.3d 412 (3d Cir. 2016). The Third Circuit in that case addressed the legal efficacy of Jersey City's requirement that developers involved in tax abated projects negotiate with labor unions who would represent all employees during negotiations for the duration of the project, and which would also bind the developers' contractors and subcontractors even if they did not ordinarily employ unionized labor and its employees were not union members.
