Professional Experience
Ms. Rogers is the firm's Labor Regulation and Union Relations practice group chair. She divides her practice between the representation of management in traditional labor matters and in employment litigation and counseling. She regularly represents large employers in the telecommunications, transportation, healthcare, pharmaceutical, and energy industries in collective bargaining, rights and interest arbitration, and in NLRB and other administrative proceedings. In the employment area, she has litigated numerous cases in the state and federal courts involving Title VII, ADA, ADEA, NJLAD, whistleblower, wrongful discharge, and breach of contract claims. She counsels clients on a wide variety of issues, including the development and implementation of policies and procedures, reductions in force, discipline, and discharge as well as wage and hour matters. Ms. Rogers also has considerable experience in privacy issues and in corporate compliance programs.
- Obtained jury verdict in favor of employer in New Jersey state court disability discrimination/wrongful discharge trial
- Received directed verdict in favor of defendant in New Jersey federal court trial of breach of contract and interference with economic advantage claims; affirmed by Third Circuit; petition for certiorari denied
- Defeated union's Pennsylvania Federal Court petition to confirm arbitration award; obtained remand of related dispute to contractual arbitration procedure
- Summary judgment for employer in New Jersey federal court sex discrimination lawsuit
- Investigated allegations of violation of compensation affecting board resolution by CEO, CFO, and General Counsel of heavily regulated company
- Summary judgment entered in favor of employer in Delaware Federal Court ADA litigation
- Summary judgment for employer in ED Pennsylvania Federal Court race-based failure-to-hire lawsuit
- Investigated alleged gender-based pay inequity involving highly compensated female employee of large publicly traded company
- Summary judgment for employer in New Jersey state court action, alleging continuing violation national origin hostile work environment and whistleblower claims
- Obtained New Jersey Federal Court Boys Markets injunction against union's illegal work stoppage, slowdown, and work to rule activities
- Summary judgment for employer in ED Pennsylvania Federal Court ERISA litigation
- Investigated whistleblower claims of internal auditor
- Summary judgment for employer on New Jersey state court national origin and breach of contract claims of former high-level executive; affirmed on appeal
