Professional Experience

Gerald "Gerry" Garfield, an experienced counselor and advocate, assists domestic and foreign clients in the public utility sector with particular emphasis on nuclear power and mergers and acquisitions. His work in the public utility area has included regulatory matters involving the Nuclear Regulatory Commission, the Federal Energy Regulatory Commission, the Environmental Protection Agency, and other federal and state agencies having jurisdiction over the siting, construction, and operation of power plants. He has also practiced before the state agencies that regulate public utilities throughout New England.

Gerry's experience includes procurement and financing of fossil and nuclear generating facilities, as well as the representation of developers, equity investors, equipment vendors and engineer/contractors in the domestic and international power development fields. Gerry has also advised utilities and other investors on utility mergers and acquisitions.

Gerry is a member of the Board of Directors of the Nuclear Energy Institute (NEI), the policy organization of the nuclear industry. He is also chair of NEI's Legal Advisory Committee. Gerry chairs Day Pitney's Nuclear Energy Practice Group.

Practice Areas

Representative Matters

  • Represented Northeast Utilities with respect to the ownership and operating arrangements for the Seabrook Nuclear plant in thebankruptcy of Public Service Company of New Hampshire and its subsequent merger with Northeast Utilities
  • Served as Special Nuclear General Counsel to Northeast Utilities and its subsidiaries, working in-house from 1996-1998, managing and coordinating all nuclear legal matters arising from the placement of the three Millstone nuclear units on the NRC's "Watch List"
  • Acted as lead outside counsel for Northeast Utilities in connection with the sale by auction of the Millstone nuclear units and Seabrook Nuclear Power Station, as well as the sale of its competitive retail and wholesale marketing businesses and generating assets
  • Advised a consortium of nuclear utilities on electric industry deregulation issues
  • Represented Deutsche Babcock AG in various development efforts in Asia and the United States
  • Represented Charter Oak Energy Company in the development and project financing of power plants in Europe and Argentina
  • Represented Colonial Pipeline Company, owner and operator of a major multistate pipeline system, in matters involving management of its electric costs
  • Represented various owners, developers, and contractors in commercial construction contracting
  • Acted as general counsel to Connecticut Yankee Atomic Power Company and Yankee Atomic Electric Company, two nuclear generating companies that are decommissioning their nuclear plants
  • Served as member of the Independent Safety and Quality Culture Assessment Team that did an independent assessment of the nuclear safety and quality culture at DOE's Waste Treatment Plant in Hanford, Washington
