Professional Experience

Gerald Garfield's work in the public utility area has included regulatory matters involving the Nuclear Regulatory Commission, the Federal Energy Regulatory Commission, the Environmental Protection Agency, and various other federal and state agencies having jurisdiction over the siting, construction, and operation of power plants. He has also practiced before the state agencies that regulate public utilities throughout New England. Gerry's practice has also included procurement and financing matters involving fossil and nuclear generating facilities, as well as the representation of developers, contractors, and equity investors in the domestic and international power development fields. Gerry has also advised utilities and other investors on utility mergers and acquisitions.

Recently, Mr. Garfield's practice has focused primarily on counseling clients regarding the commercial and regulatory arrangements needed for nuclear "new build," including licensing, engineering, procurement, construction, power purchase and ownership arrangements.

Practice Areas

Representative Matters

  • Represented Northeast Utilities with respect to the ownership and operating arrangements for the Seabrook Nuclear plant in the bankruptcy of Public Service Company of New Hampshire and its subsequent merger with Northeast Utilities
  • From 1996 to 1998, worked in-house as Special Nuclear General Counsel to Northeast Utilities and its subsidiaries, managing and coordinating all nuclear legal matters arising from the placement of the three Millstone nuclear units on the NRC's "Watch List"
  • Acted as lead outside counsel for Northeast Utilities in connection with the sale by auction of the Millstone units and Seabrook Station
  • Advised a consortium of nuclear utilities on electric industry deregulation issues
  • Represented Deutsche Babcock AG in various development efforts in Asia and the United States
  • Represented Charter Oak Energy Company in the development and project financing of power plants in Europe and Argentina
  • Represented Colonial Pipeline Company, owner and operator of a major multistate pipeline system, in matters involving management of its electric costs
  • Represented various owners, developers, and contractors in commercial construction contracting
  • Acted as general counsel to Connecticut Yankee Atomic Power Company and Yankee Atomic Electric Company, two nuclear generating companies that are decommissioning their nuclear plants
