Professional Experience
With over 30 years of litigation experience, Mr. Rose's practice has included assisting his clients, from large multinationals to local businesses, in a variety of complex litigated matters, both at the trial and appellate levels in state and federal court as well in arbitration proceedings and in other forms of alternative dispute resolution. Mr. Rose is also the firm's Construction Law practice group chair.
His business practice has included trials in which he has obtained verdicts in excess of a million-dollars, and he regularly defends business entities of all sizes in commercial litigation. He won a million-dollar trial verdict on behalf of a client in a tenancy dispute with its landlord over the loss of a leasehold interest in a condemnation proceeding. He has counseled clients in a variety of constructions disputes and litigation, including a defense verdict following a four-week jury trial involving allegations of faulty materials supplied to a public works project.
In an environmental insurance litigation, he obtained a settlement in excess of $80 million on behalf of a multinational corporation. Over the last 20 years he has represented clients involved in virtually every superfund site in New Jersey.
Recent representations include the successful prosecution and settlement of a multimillion-dollar claim by an insurer against its broker for negligence and fraud, the settlement of a multimillion-dollar claim by a multinational against its former actuarial consultant for malpractice in connection with the preparation of a defined benefits plan, the defense of a large manufacturer in a multimillion-dollar construction suit, and the prosecution of a suit in federal court for the multimillion-dollar loss of cargo destroyed in a plane crash.
At the appellate level Mr. Rose has appeared in the Second, Third, and District of Columbia Circuit Courts of Appeals. On appeal of a trial verdict in excess of $100 million on behalf of a multinational corporation in an environmental suit, Mr. Rose successfully argued for a reversal of the judgment in the Third Circuit. On behalf of an architect charged with malpractice, he wrote the brief that resulted in the reversal of a multimillion-dollar verdict on appeal. Before the District of Columbia Circuit he challenged key provisions of the Bus Reform Act on behalf of an interstate carrier. Before the Appellate Division in New Jersey he challenged regulations prohibiting discount coupons by pharmacies in the sale of prescription drugs and a reported opinion reversing a jury award of over $3 million dollars in an attorney malpractice case.
Earlier in his career, Mr. Rose served as a law clerk to The Honorable John J. Gibbons, circuit judge of the United States Court of Appeals for the Third Circuit, 1974-1975.
