Professional Experience
Mr. Haglund practices in the areas of product liability disputes, shareholder/investor suits, and commercial disputes. Mr. Haglund's experience includes jury trials, bench trials, arbitration hearings, and mediation in complex matters, as well as evaluation and planning of short- and long-term litigation strategy at the state, regional, and national levels. Mr. Haglund leads joint litigation defense groups in New Jersey and New York and also serves as lead medical counsel and liaison counsel.
- Product Liability/Toxic Tort:
Defense of a cable and wire manufacturer in over 425 cases filed by electricians in New York, Pennsylvania, and New Jersey; as a part of this defense, Mr. Haglund conducted a consolidated Middlesex County jury trial of 13 cases alleging injury and death from work with asbestos-containing wire and cable; the evidence at trial was complex and spanned the fields of engineering, industrial hygiene, electron microscopy, pathology, pulmonology, radiology, and internal and occupational medicine; after three months of trial and three weeks of deliberation, the jury returned defense verdicts in favor of our client in all cases; Mr. Haglund successfully defended the jury's verdicts on appeal, thereby defeating the plaintiff's efforts to establish a form of industry-wide liability in all toxic tort cases in New Jersey
Defense of supplier of construction materials in over 250 asbestos personal injury actions filed in Middlesex County, New Jersey
Defense of manufacturers of pumps, valves, and construction materials in over 150 asbestos personal injury cases filed in Middlesex County, New Jersey
Personal counsel to former shareholders of valve manufacturer in issues arising from asbestos personal injury suits filed against the valve manufacturer in New York, New Jersey, and other jurisdictions
Defense of major New York bank as a premise owner in personal injury suits filed in the Southern District of New York arising from the terrorist attacks of September 11, 2001
Defense of premise owners in asbestos personal injury suits filed in New York, New Jersey, Texas, and Delaware relating to premises located in New York, New Jersey, Arizona, Texas, and Tennessee
Defense of seven major chemical manufacturers in an action by over 250 former employees of an aircraft parts manufacturing facility alleging exposure to chemical products manufactured and/or supplied by 35 defendants; Mr. Haglund served as lead counsel for all defendants; obtained summary judgment for all clients
Defense of chemical repackaging company in actions by over 100 plaintiffs alleging groundwater contamination; the judgment withstood the plaintiff's challenge on appeal
- Shareholder/Investor Suits:
Prosecution of actions on behalf of 35 limited partners in federal multidistrict litigation arising out of purchase of interests in limited partnerships that were building and operating ethanol production facilities in New Mexico and Louisiana
Prosecution of breach of fiduciary duty action on behalf of substantial individual investor against investment advisor who failed to diversify investments
Prosecution and trial to verdict of close corporation dispute on behalf of shareholder claiming 50 percent ownership of commercial office building; after trial, a significant judgment was entered in favor of our client
Defense of diversified U.S. holding company in a claim arising out of the company's $175 million sale of 100 percent of the stock in one of its subsidiary food companies; the action was settled on terms favorable to our client
Defense of a lease broker victimized by a photocopier-leasing Ponzi scheme; the plaintiff sought $30 million in compensatory damages against the lease brokers, banks, and leasing agents; the action was settled on terms favorable to our client
Defense of leading international appraisal company in an action arising out of the purchase of substantially all of the assets of an equipment manufacturing business; the purchaser sought compensatory damages in excess of $6 million against our client; obtained summary judgment and successfully defended this matter on appeal
- Commercial Disputes:
Prosecution and trial to verdict on claims involving sales of silicone products; our client was awarded $2.2 million in compensatory damages and attorneys fees plus a three-year, world-wide injunction against a former vice president based upon his diversion of suppliers, customers, and products
Prosecution of counterclaim based on sales of defective steel coatings and paints that had been applied to thousands of commercial truck trailers across North America; after a full series of arbitration hearings, a significant net award was entered in favor of our client, the truck trailer manufacturer
Prosecution of emergent action on behalf of a clothing manufacturer against a warehouseman to release $5 million of retail clothing inventory
Prosecution of emergent trademark infringement and counterfeiting actions including obtaining ex parte orders to seize and destroy infringing goods
