Stamford partner Daniel Schwartz and associate Sarah DePanfilis were victorious December 14 when the Second Circuit Court of Appeals held that although alcoholism can be considered a disability under the Americans with Disabilities Act, it does not protect an employee who fails to show up for work.

The three-judge panel dismissed the plaintiff's claim that he was wrongfully terminated for being disabled and retaliated against for taking medical leave to receive treatment.
